Terms and Conditions

1. Scope

These terms and conditions apply to all contracts concluded between COMFORSH and its customers through the COMFORSH online shop.
The offer is directed at both consumers and business customers.

2. Definitions

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

A business customer is a natural or legal person, or a partnership with legal capacity, who acts in the exercise of their trade, business or profession when concluding the contract.

3. Offer and conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer to conclude a contract of sale, but an invitation to the customer to submit a binding offer.

The customer may first place the desired products in the shopping cart without obligation.
Before completing the order, the customer can review and, where necessary, correct all entries.

By clicking the correspondingly marked order button, the customer submits a binding offer to conclude a contract of sale for the goods in the shopping cart.

After the order is received, the customer receives an automatic confirmation by email.
This automatic acknowledgement of receipt does not yet constitute acceptance of the offer, unless it expressly declares such acceptance.

The contract is concluded when COMFORSH expressly accepts the order or when the goods are handed over for dispatch to the customer, unless express acceptance has already taken place beforehand.

4. Contract language

The contract language is German.
Where the online shop offers further languages, product information and other content may additionally be provided in those languages.

5. Storage of the contract text

The contract text is stored by COMFORSH within the framework of statutory requirements.
The order data and the information relevant to the conclusion of the contract are made available to the customer in text form after the order is completed, in particular by email.
The customer can save or print the contract documents.

6. Prices

The prices stated in the online shop are total prices and include the applicable statutory VAT, unless expressly stated otherwise.
Additional shipping costs are shown to the customer before the order is completed.

For deliveries to countries outside the European Union, additional customs duties, import VAT, levies or other costs may arise depending on the destination country.
Where such costs are not already included or shown in the order process, they may have to be borne by the customer towards the competent authorities or service providers.

7. Payment terms

Various payment methods are available in the online shop.
Depending on the delivery country and technical availability, the following payment methods in particular may be offered:

The payment methods actually available are shown to the customer during the ordering process.
For certain payment methods, an additional check may be carried out by the respective payment service provider.
For payments via external payment service providers, their respective business and payment terms apply in addition.

8. Invoicing

Invoices are issued by COMFORSH as the seller and contracting party of the customer.

Delivery may be handled by external shipping, fulfilment or logistics partners.

9. Delivery

Delivery is made to the delivery address provided by the customer.
COMFORSH is entitled to use external shipping, fulfilment and logistics service providers to fulfil its contractual obligations.
The goods may therefore be dispatched to the customer directly by a commissioned delivery or logistics partner.

Unless stated otherwise for the individual product, the standard delivery time is approximately 7 to 15 working days.
For international deliveries, longer delivery times may arise due to customs clearance, import controls, transport delays or other circumstances.
Different delivery times may apply to individual products. The information on the respective product page or in the ordering process is decisive.

10. Shipping costs

Shipping costs may vary depending on the product, delivery country, shipping method and order size.
The shipping costs applicable to the respective order are shown to the customer at the latest before the ordering process is completed.

11. Deliveries to countries outside the EU

For deliveries to countries outside the European Union, import duties, customs charges, taxes or other official fees may arise.
The applicable import provisions are governed by the law of the destination country.
Where such costs are not part of the total price stated in the shop, they may have to be borne by the customer.

12. Retention of title

The goods remain the property of COMFORSH until the purchase price has been paid in full.
Towards business customers, retention of title also applies until all claims arising from the ongoing business relationship have been settled in full, as far as legally permissible.

13. Right of withdrawal for consumers

Consumers are generally entitled to a statutory right of withdrawal in distance contracts.
Details are set out in the separate withdrawal policy.
The right of withdrawal does not apply where a statutory exclusion under § 312g (2) BGB applies.
As COMFORSH generally offers pre-manufactured standard products, the right of withdrawal is not excluded merely on the grounds of individual production.

14. Statutory liability for defects

The statutory provisions on liability for defects apply.
Towards consumers, the mandatory statutory provisions on the sale of consumer goods apply in particular.
In the case of defective goods, the customer has the statutory rights to subsequent performance and – where the statutory conditions are met – where applicable to withdrawal, reduction of the price or damages.
An additional guarantee exists only where it is expressly designated as a guarantee for the respective product and its conditions are stated.

15. Provisions for business customers

The statutory right of withdrawal for consumers does not apply to business customers.
Business customers must inspect the goods on receipt for completeness and obvious defects within the framework of the statutory provisions, and must report obvious defects within the statutory requirements.

16. Product safety

COMFORSH provides the product information, manufacturer details, safety information and warnings required for the respective product in accordance with statutory requirements.
Product-specific information is provided on the respective product page or at the place designated for it in the online shop.
The provisions of the EU General Product Safety Regulation (GPSR) are taken into account for the products concerned. The GPSR has applied since 13 December 2024.

17. Liability

COMFORSH is liable without limitation for damage arising from injury to life, body or health based on an intentional or negligent breach of duty.
COMFORSH is further liable without limitation for damage based on intent or gross negligence.
In the event of a slightly negligent breach of material contractual obligations, COMFORSH is liable only for foreseeable damage typical of the contract.
The above limitations of liability do not apply where mandatory statutory provisions conflict with them.
Liability under the German Product Liability Act remains unaffected.

18. Set-off

The customer is entitled to set-off only where their counterclaims have been legally established, are undisputed or have been acknowledged by COMFORSH.

19. Right of retention

A right of retention may only be exercised where the counterclaim arises from the same contractual relationship.

21. Consumer dispute resolution

COMFORSH is not obliged and generally not willing to take part in dispute resolution proceedings before a consumer arbitration board, unless required to do so by law.

22. Applicable law

German law applies to contracts with consumers.
For consumers, this applies only to the extent that it does not deprive them of the protection of mandatory provisions of the law of the state in which they have their habitual residence.
German law applies to contracts with business customers, excluding the UN Convention on Contracts for the International Sale of Goods.

23. Place of jurisdiction

For consumers, the statutory places of jurisdiction apply.
For business customers, legal entities under public law or special funds under public law, the registered place of business of COMFORSH is agreed as the place of jurisdiction, as far as legally permissible.

24. Severability

Should any provision of these terms and conditions be or become wholly or partly invalid, the validity of the remaining provisions remains unaffected.
The statutory provisions apply in place of the invalid provision.
